Pay-To-Delay Settlements On The Rise
May 2008 | Industry NewsThe number of agreements between branded and generic drug manufacturers that restrict market entry for generics has increased dramatically over the past few years, according to the latest Federal Trade Commission (FTC) report. During FY2007 (ending September 30 2007) there were 33 final settlements, of which 25 resulted in restrictions on generic entry. Of these, 14 (56%) involved some form of compensation given to the generics manufacturer. Of all the agreements, the bulk (79%) involved first-filer generics companies. These are companies who should be guaranteed 180 days exclusivity to sell a drug following patent
