Compulsory Licenses Sought
May 2007 | Trade AlertAs a sign of strength in its Free Trade Agreement (FTA) negotiations with the US, Malaysia has clearly stated that it is seeking the right to issue compulsory licenses on patented drugs. It is BMI's view that while Malaysia will be allowed to do this, as permitted by World Trade Organization (WTO) rules, the country will be strongly discouraged to do so by the US, as the profits of multinational drugmakers will be negatively impacted.
