Branded Drug Firms Attack Generics Rules
October 2006 | Legal NewsInnovator drug companies operating in Spain have launched an attack on provisions regarding generic substitution in the new Medicines Law. Article 85 encourages pharmacists to substitute branded drugs with a generic formulations of the same API, wherever available. Branded drug firms have argued that this discriminates against their products, partly in view of weaknesses in Spain's patent laws - leading to a likely decline in R&D
